1. Acceptance of Terms

By accessing and using the Construction Execution System (CES) and related services provided by CES Group, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

CES Group provides a digital Construction Execution System that includes:

• Mobile and web-based work order management
• Real-time project tracking and reporting
• ERP system integration capabilities
• Construction site data analytics
• Cloud-based or on-premise hosting options

3. User Accounts and Registration

To access our services, you must:

• Provide accurate and complete registration information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

4. Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these terms. You agree not to:

• Use the service for any unlawful purpose or in violation of any regulations
• Attempt to gain unauthorized access to our systems or data
• Interfere with or disrupt the service or servers
• Use the service to transmit viruses or other harmful code
• Reverse engineer or attempt to extract source code from our software

5. Intellectual Property

The Construction Execution System, including all software, text, graphics, logos, and other content, is owned by CES Group and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our proprietary technology.

6. Data Ownership and Privacy

You retain ownership of all data you input into the CES system. We process your data in accordance with our Privacy Policy and applicable data protection laws. We implement appropriate security measures to protect your data but cannot guarantee absolute security.

7. Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted service. We may temporarily suspend service for maintenance, updates, or other operational reasons. We will provide reasonable notice when possible.

8. Payment and Billing

For paid services:

• Fees are charged in advance on a subscription basis
• All payments are non-refundable except as required by law
• We may change our fees with reasonable notice
• Failure to pay may result in suspension of service

9. Limitation of Liability

CES Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of our services. Our total liability for any claims shall not exceed the amount paid by you for the service in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold CES Group harmless from any claims, damages, or expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.

11. Termination

Either party may terminate the service agreement at any time with appropriate notice. Upon termination, your access to the service will cease, and we will provide you with a reasonable opportunity to export your data.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of Sweden. Any disputes shall be resolved in the courts of Stockholm, Sweden.

13. Mobile Application Terms

Additional terms for mobile application users:

• App store terms and conditions apply
• Updates may be required for continued functionality
• Device permissions are used only for stated functionality
• Offline functionality may be limited

14. Changes to Terms

We may update these terms from time to time. We will notify users of significant changes via email or through our service. Continued use of the service after changes constitutes acceptance of the new terms.
